1. Agreement to Terms

By downloading, installing, or using GymForm ("the App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

2. Description of Service

GymForm is an AI-powered exercise form analysis app. The App allows you to record or upload exercise videos, receive AI-generated coaching feedback on your technique, track your form progress over time, and build consistent training habits.

3. Important Health and Safety Disclaimer

GymForm provides general coaching feedback based on AI analysis of exercise videos. This is not medical advice.

  • GymForm is not a substitute for professional medical advice, diagnosis, or treatment.
  • Always consult a qualified healthcare professional or certified personal trainer before starting any new exercise program.
  • If you experience pain, discomfort, dizziness, or any other symptoms during exercise, stop immediately and seek medical attention.
  • The AI feedback provided is for general informational purposes only and may not account for your individual health conditions, injuries, or physical limitations.

By using GymForm, you acknowledge that you exercise at your own risk and that GymForm bears no responsibility for any injury, illness, or harm that may result from the feedback provided.

4. Eligibility

You must be at least 13 years of age to use GymForm. If you are between 13 and 18, you represent that you have obtained parental or guardian consent.

5. Account Registration

Account creation is optional. You may use GymForm without registering, with your data stored locally on your device. If you create an account, you are responsible for maintaining the confidentiality of your credentials and all activity under your account.

6. Subscriptions and Payments

6.1 Subscription plans

GymForm offers paid subscription plans. Current pricing is displayed within the App and on our App Store listing.

6.2 Free trial

New subscribers may be offered a free trial. At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel at least 24 hours before the trial ends.

6.3 Billing

Subscriptions are billed through Apple's in-app purchase system and automatically renew unless cancelled at least 24 hours before the end of the current billing period.

6.4 Cancellation

Cancel via your Apple ID account settings or via Profile → Manage Subscription within the App. Cancellation takes effect at the end of the current billing period.

6.5 Refunds

Refund requests are handled by Apple. Contact Apple Support at reportaproblem.apple.com.

6.6 Restore Purchases

You can restore a previous purchase via the "Restore Purchases" button on the subscription screen.

6.7 Fair use

Subscriptions are intended for personal, individual use. To prevent abuse and ensure service quality for all users, GymForm applies a fair-use limit to the number of AI video analyses you may run per month. We may adjust this limit or contact users whose usage materially exceeds typical personal use.

7. Your Content

When you submit a video for analysis, you grant GymForm a limited, temporary licence to process that video solely to generate coaching feedback. Videos are not stored after analysis is complete.

You are solely responsible for any content you submit. You represent that you own or have the right to submit the content and that it does not violate any laws or third-party rights.

8. Prohibited Uses

You agree not to use GymForm to violate any laws, infringe intellectual property rights, submit harmful or offensive content, attempt unauthorised access to the App or its infrastructure, reverse engineer or decompile the App, or use the App for commercial purposes without our written consent.

9. Intellectual Property

The App and all its content, features, and functionality are owned by GymForm and protected by applicable intellectual property laws. These Terms do not grant you any rights beyond the limited right to use the App as set out herein.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, GYMFORM DISCLAIMS ALL WARRANTIES INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF AI-GENERATED FEEDBACK, AND UNINTERRUPTED OR ERROR-FREE SERVICE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GYMFORM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING PHYSICAL INJURY RESULTING FROM EXERCISE. GYMFORM'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless GymForm and its officers, directors, employees, and agents from any claims arising out of your use of the App, your violation of these Terms, or any injury sustained while exercising.

13. Account Deletion

Delete your account at any time via Profile → Settings → Delete Account. All personal data will be permanently deleted from our servers within 30 days. Any active subscription must be cancelled separately through Apple.

14. Termination

We may suspend or terminate your access at any time for any reason including violation of these Terms. Sections 3, 10, 11, 12, and 16 survive termination.

15. Governing Law

These Terms are governed by the laws of Sweden. Any disputes shall be subject to the exclusive jurisdiction of the courts of Sweden.

16. Changes to These Terms

We may modify these Terms at any time. Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms.
